Welcome to SwingMatch.AI. These Terms of Service ("Terms") govern your access to and use of the SwingMatch.AI mobile application, website, and related services (collectively, the "Service") operated by SwingMatch.AI ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account, downloading the application, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the updated Terms.

2. Description of Service

SwingMatch.AI is an AI-powered golf swing analysis platform that provides:

• Swing Analysis: Automated biomechanical analysis of golf swing videos using artificial intelligence.
• Tour Player Matching: AI-driven matching to tour professionals based on your physical attributes and current swing mechanics.
• Tour Player Rebuilding: Side-by-side comparison and coaching to reshape your swing toward a tour professional of your choosing.
• Personalized Coaching: AI-generated coaching recommendations, drill sequences, and progress tracking tailored to your swing.
• Multilingual Support: Service availability in multiple languages.

3. Account Registration

To use the Service, you must create an account. When registering, you agree to:

• Age Requirement: You must be at least 13 years of age to create an account and use the Service. If you are under 18, you must have parental or guardian consent.
• Accurate Information: You will provide accurate, current, and complete information during registration and keep your account information up to date.
• One Account: You may maintain only one account per person. Creating multiple accounts may result in suspension or termination of all associated accounts.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. User Content

Ownership: You retain all ownership rights to the videos, images, and other content you upload to the Service ("User Content"). SwingMatch.AI does not claim ownership of your User Content.

License Grant: By uploading User Content, you grant SwingMatch.AI a non-exclusive, worldwide, royalty-free license to use, process, analyze, store, and display your User Content solely for the purpose of providing and improving the Service. This includes processing your videos through our AI analysis pipeline to generate swing analysis, biomechanical data, coaching recommendations, and tour player comparisons.

Responsibility: You are solely responsible for the User Content you upload. You represent that you have the right to upload and share any content you submit and that your User Content does not violate any third party's rights.

5. AI-Generated Content

Informational Only: All coaching recommendations, swing analysis results, biomechanical assessments, drill suggestions, and other AI-generated content provided through the Service are for informational and educational purposes only.

Not Professional Advice: AI-generated content does not constitute professional golf instruction, medical advice, physical therapy, or fitness guidance. The Service is not a substitute for in-person instruction from a qualified golf professional, sports medicine physician, or physical therapist.

Use at Your Own Risk: You acknowledge that AI-generated coaching recommendations may not account for individual physical limitations, injuries, or medical conditions. You assume all risk associated with following any recommendations provided by the Service and should consult appropriate professionals before undertaking any new physical activity or exercise regimen.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Upload content that is obscene, offensive, threatening, defamatory, or that infringes on any third party's intellectual property or privacy rights.
• Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application, AI models, or analysis algorithms.
• Scrape, crawl, or use automated means to access the Service or extract data, including but not limited to tour player data, coaching knowledge, or biomechanical databases.
• Interfere with, disrupt, or place an undue burden on the Service or its infrastructure.
• Attempt to gain unauthorized access to any portion of the Service, other users' accounts, or any systems or networks connected to the Service.
• Use the Service to develop a competing product or service.
• Resell, redistribute, or sublicense access to the Service or any content generated by the Service without our prior written consent.

7. Intellectual Property

The Service, including but not limited to the SwingMatch.AI application, website, AI models, analysis algorithms, coaching knowledge base, tour player biomechanical data, design system, and all associated trademarks, logos, and branding, is the exclusive property of SwingMatch.AI and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying technology without our express written permission. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information, including swing videos, physical profile data, and analysis results. By using the Service, you consent to the data practices described in our Privacy Policy.

9. Subscription and Payments

Beta Period: The Service is currently offered free of charge during the beta period. Features, availability, and functionality may change during this time without notice.

Future Subscriptions: We may introduce paid subscription plans in the future. If we do, we will provide advance notice of pricing and terms. Any paid features will require your explicit consent before charges are applied.

Cancellation: If paid subscriptions are introduced, you may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period, and you will retain access to paid features until that time. Refund policies will be communicated alongside any future subscription plans.

App Store Purchases: If subscriptions are offered through the Apple App Store or Google Play Store, those purchases are also subject to the respective store's terms and conditions.

10. Disclaimers

As-Is Service: The Service is provided on an "as-is" and "as-available" basis, particularly during the beta period. We make no warranties, express or implied, regarding the reliability, accuracy, availability, or fitness for a particular purpose of the Service.

Not Professional Instruction: SwingMatch.AI is not a substitute for professional golf instruction. AI analysis, while based on extensive biomechanical data and coaching knowledge, may contain errors or produce recommendations that are not suitable for your individual circumstances.

No Liability for Injuries: Golf is a physical activity that carries inherent risks. SwingMatch.AI is not liable for any physical injuries, strains, or other harm that may result from following AI-generated coaching recommendations or drills. Always warm up properly, respect your physical limitations, and consult a healthcare professional if you have any medical conditions or concerns.

Beta Limitations: During the beta period, the Service may experience downtime, bugs, data loss, or other issues. We will make reasonable efforts to maintain the Service but cannot guarantee uninterrupted access.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SwingMatch.AI, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service, regardless of the theory of liability.

In no event shall SwingMatch.AI's total aggregate liability to you for all claims arising out of or relating to the Service exceed the amount you have paid to SwingMatch.AI in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by providing additional notice through the application or via email.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may request deletion of your account.

13. Termination

By You: You may stop using the Service and request deletion of your account at any time by contacting us.

By Us: We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason we deem appropriate. This includes, but is not limited to:

• Violation of the Acceptable Use provisions in Section 6.
• Providing false or misleading information during registration.
• Engaging in fraudulent or abusive activity.
• Creating multiple accounts in violation of these Terms.

Upon termination, your right to use the Service will immediately cease. We may, at our discretion, delete your account data and User Content following termination in accordance with our Privacy Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration or the courts of competent jurisdiction, as determined by applicable law.

You agree that any claim or cause of action arising out of or relating to the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred.
